General Liability – $8.25 million
The Plaintiff, a 60-year-old union elevator operator on a construction site, obtained an $8.25 million settlement for severe respiratory injuries caused by prolonged exposure to concrete and silica dust in an improperly ventilated Boston construction project. Counsel found numerous employees on the construction site who complained to the General Contractor about air quality to no avail. In addition, Plaintiff proved that the Air Quality Plan created by the General Contractor was inadequate as written and that the General Contractor did not even follow its poor Air Quality Plan. Despite repeated complaints, the contractors failed to provide adequate ventilation or respiratory protection. The Plaintiff developed chronic lung disease and sustained fractured ribs from persistent coughing, requiring multiple surgeries. He remains permanently impaired.
Premises Liability – $3.3 million
The Plaintiff, a 31-year-old woman, obtained a $3.3 million judgement arising from injuries sustained when a light fixture fell from the ceiling of an elevator and struck her on the head. The Plaintiff alleged that the property owner was negligent in failing to properly inspect, maintain, and repair the elevator, thereby allowing a dangerous condition to exist. The defense denied they had any notice of any dangerous condition before the light fixture fell. As a result of the incident, the Plaintiff sustained a traumatic brain injury which resulted in chronic post-concussion symptoms, cognitive impairment, and permanent neurological damage that triggered an underlying pre-disposition to bipolar disorder. The defense contended that, at most, the Plaintiff suffered a mild concussion as she did not lose consciousness and may have not had an altered consciousness and had a normal CT scan. The defense contended that her bi-polar was genetic and not related to any possible concussion. The Plaintiff’s Counsel arranged for advanced neuroimaging that showed a small bleed deep in her brain as well as white matter damage. The Defense unsuccessfully challenged the admissibility of the testing. After a week-long trial, the Plaintiff was awarded over 1.7 million dollars at trial that became a judgement of 3.1 million dollars with pre-judgement interest. During the appeal, the matter was resolved for $3.3 million due to the post judgement interest, compensating her for pain and suffering, medical expenses, lost wages, and permanent disability.
Premises Liability – $3.3 million
The Plaintiff, a 45-year-old man obtained a $3.3 million settlement for injuries sustained while performing inspection duties at a fuel terminal. The Plaintiff slipped and fell on accumulated ice that the Defendant allegedly failed to remove or treat, resulting in a severe left shoulder injury. The Defendant alleged he was negligent and walked carelessly that led to his fall. The Plaintiff demonstrated that ice was the result of deliberate choices made by the defense to allow water to accumulate in the terminal in the winter. The Plaintiff underwent multiple surgeries, including a reverse shoulder replacement, and continues to suffer from chronic pain and weakness. He remains permanently disabled from employment. The defense contested causation noting that he had suffered a rotator cuff tear before this incident and had an arthritic shoulder.
Premises Liability – $2.7 million
The Plaintiff, a 34-year-old ironworker, obtained a settlement of 2.7 million dollars when he fell through an improperly supported floor on a construction site and impaled his leg on an exposed rebar cap. The Defense alleged he was negligent in that he was warned that the floor could not support his weight and stepped on it anyway. As a result of the incident, the Plaintiff suffered a leg injury and post-traumatic stress. He did return to work at a lighter duty job out of the trades and the settlement represented compensation for his pain and suffering as well as past medical bills and past and future lost earning capacity.
Premises Liability – $2 million + $125k Workers’ Comp Settlement
The Plaintiff, a 60-year-old man, suffered a concussion while making a delivery to a liquor store after tripping over a bolt protruding from a stairway. The Plaintiff alleged the Defendants were negligent in failing to inspect, maintain, or repair the hazardous condition and in allowing the dangerous obstruction to remain. The Defense argued that the bolt was open and obvious and Plaintiff should have seen it. As a result, the Plaintiff fell down several steps and struck his head on a pole, sustaining a concussion and a brief loss of consciousness. He subsequently developed post-concussion syndrome, characterized by chronic migraines, dizziness, visual and cognitive impairments, and seizure activity. Despite extensive neurological, visual, and rehabilitative treatment, he remains permanently and totally disabled although the defense contested and stated he had recovered from his injuries. The Plaintiff recovered $2 million in a third-party negligence settlement, in addition to $125,000 from a related workers’ compensation claim.
Construction Site Injury – $1,873,000
The Plaintiff, a 38-year-old union mason, obtained a $1,873,000 million settlement for injuries sustained after stepping into stair landing where a grate had been removed creating a hole while inspecting swing staging. The Plaintiff brought suit against the General Contractor and the scaffold erector. The hole had been left open and unmarked after a grate was removed during scaffolding setup, creating a concealed fall hazard. The defense argued that the hole was open and obvious and intimated that the Plaintiff’s employer may have created the hole. The Plaintiff alleged that the scaffolding erector created the hole in setting up the swing staging and that the General Contractor should have noticed the hole before the incident. The Plaintiff fell several feet, suffering a left knee injury that ultimately required a total knee replacement. The defense noted that the Plaintiff had a long history of knee pain and arthritis in the knee and the accident played no role in the need for a knee replacement. The injury left him permanently impaired and unable to return to his pre-injury occupation.
Premises Liability – $1.4 Million + $150k Workers’ Comp Settlement
The Plaintiff, a 38-year-old laborer, obtained a $1.4 million settlement after falling 28 feet onto a concrete floor when he stepped on a baffle that could not withstand his weight. He alleged that the Defendant, the owner of the facility, was negligent in failing to ensure that the workers had tie off points. The Plaintiff sustained multiple traumatic injuries, including traumatic brain injury, fractures to his clavicle, arm, and ribs, a left knee meniscus tear, and a right shoulder impingement requiring several surgeries. He continues to experience chronic pain, limited mobility, and lasting neurological symptoms that prevent him from returning to work. In addition to the third-party settlement, the Plaintiff recovered $150,000 through a workers’ compensation claim, for a total recovery of over $1.5 million.
Motor Vehicle Accident – $1 million
The Plaintiff’s decedent, a 19-year-old woman, was fatally injured on I-290 after a passenger’s reckless act of grabbing the steering wheel caused the vehicle to spin out and come to rest facing oncoming traffic, where it was struck by a tractor-trailer traveling at an excessive speed without breaking. The suit alleged that the truck driver, due to his poor health and sleep habits, failed to maintain proper vigilance and control and that the trucking company was vicariously liable for his negligence. Both the passenger and truck driver were accused of gross negligence resulting in the fatal collision. The decedent was driving while intoxicated as her blood alcohol was twice the legal limit at the time of the crash and there were also cocaine and marijuana in her system. The case settled for $1 million.

The Plaintiff, a 55-year-old senior research administrator, alleged that he fell through a defective drain cover while stepping down from a ladder causing an injury to his knee requiring a knee replacement. The defense contended that the drain cover could not have flipped and thus the Plaintiff was being untruthful as to how the incident happened They also claimed that the knee replacement was necessary because of pre-existing arthritis.
Motor Vehicle Accident – $5,805,000
The Plaintiff, a 30-year-old woman, was lawfully crossing the street when she was fatally struck by a transportation van operated by the Defendant. The lawsuit alleged that the driver failed to maintain proper lookout and control of the vehicle and that the municipality was negligent in its supervision of the transportation service. Liability for the incident was apportioned between the van driver and the municipality. As a result, the Plaintiff’s estate obtained a settlement of $2,125,000 in this action, contributing to a total recovery of $5,805,000 from all related claims.
Construction Site Injury – $2.25 million + $450k Workers’ Comp Settlement
The Plaintiff, a 55-year-old construction worker, obtained a $2.25 million settlement for injuries sustained during a school renovation project when he fell after stepping onto an unstable area near a concrete transformer pit. The pit had been left improperly covered and unmarked, creating a concealed hazard. The suit alleged that the general contractor failed to properly inspect, secure, or warn workers about the dangerous condition. The Plaintiff suffered torn rotator cuffs in both shoulders and a fractured left ankle, each requiring surgery and extensive rehabilitation. He continues to experience chronic pain and permanent mobility limitations that prevent his return to work. Including ga $450,000 workers’ compensation settlement, the Plaintiff’s total recovery was $2.7 million.
General Liability – $1 million
The Plaintiff, a 48-year-old lineman, obtained a $1 million settlement for injuries sustained in a motor vehicle accident that occurred while responding to storm-related power outages. He was a passenger in a company-owned bucket truck operated by a coworker when the vehicle’s brake system failed as it descended a steep hill. The truck lost control and overturned, fatally injuring the driver and causing the Plaintiff to suffer serious physical and psychological injuries. The complaint alleged that the Defendant failed to properly service and maintain the vehicle, and that its defective brakes caused the crash. It was further alleged that the employer’s insurer acted negligently in maintaining inadequate coverage, resulting in complex litigation over liability and insurance obligations. The case resolved for $1 million as a compromise of disputed claims and to avoid continued litigation.
Motor Vehicle Accident – $3.25 million
The Plaintiff, a 28-year-old man, obtained a $3.25 million settlement arising from a motor vehicle crash caused by a rideshare driver who made a sudden and unsafe left turn in front of the Plaintiff’s oncoming motorcycle. The Plaintiff, who had the right of way, collided with the vehicle and became trapped underneath, suffering life-threatening injuries that required seventeen days in the ICU, more than fifteen surgeries, and months of rehabilitation. His injuries included multiple femur fractures, a cervical fracture, degloving abdominal wounds, rib and spinal fractures, and permanent scarring and disfigurement. The settlement compensates the Plaintiff for pain and suffering, permanent impairment, medical expenses, and loss of earning capacity.
Elevator injury – $4.5 million
Third-party settlement for severe injuries sustained when a freight elevator malfunctioned and crashed to a lower level, entrapping and crushing plaintiff’s leg and leaving him permanently disabled from work.
Health insurance contract breach – $2.15 million
Settlement on behalf of a Massachusetts entity for alleged breach of health insurance contract.
Construction site injury –$1.6 million

Motor Vehicle Accident – $1.1 million
The Plaintiff/pedestrian, a 49-year-old woman, obtained a $1.1 million recovery for injuries sustained when she was struck by a vehicle while crossing the street. Although the Defendant was not speeding at the time of the incident, the evidence revealed that the driver was not using his sun visor and had a dirty windshield, making it difficult for him to see the Plaintiff due to solar glare. The force of the impact caused the Plaintiff to be thrown onto the hood of the car and into the windshield before landing on the pavement. She suffered multiple serious injuries, including a fractured C-1 vertebra, subarachnoid brain hemorrhage, and a leg fracture requiring surgery and extensive rehabilitation. The Plaintiff also sustained a facial laceration resulting in a small scar above her eyebrow. The Plaintiff did not have a full-time job at the time of the incident so there was only minimal loss of earnings claimed.
Motor Vehicle Accident – $1 million
In August 2022, the 19-year-old plaintiff sustained a displaced intra-articular lateral tibial plateau fracture and dislocation of the left patella when the defendant failed to yield the right of way and turned in front of the vehicle in which the plaintiff was a front seat passenger. The plaintiff underwent surgery, a long course of physical therapy, and eventually a second surgery to remove hardware. The potential for post-traumatic osteoarthritis and eventual need for further treatment, including a possible knee replacement, and the plaintiff’s young age were driving factors in settlement negotiations.
