When you are involved in a motor vehicle accident it is important to keep several things in mind. You should always exchange information with the driver of the other vehicle and contact the police so that a report is made and the accident details are documented. If you are injured, you should seek immediate medical attention and seek follow-up care as necessary. Most of us have cameras on our cell phones so take photographs of the damage to the vehicles and the scene of the accident.

No-fault insurance

Chances are you have heard of no-fault insurance, but you may not know what it is. When you are involved in a motor vehicle accident, regardless of who caused the accident, you are eligible to receive benefits from your own insurance for medical bills, lost wages, and replacement services. These are known as Personal Injury Protection, or PIP, benefits. It is important to check your coverage to make sure you do not have a PIP deductible, which may preclude you from being able to receive PIP benefits. PIP benefits are important because where some people may not have health insurance, this coverage can help you seek the medical care you need without incurring excessive medical bills you may not be able to pay.

You may also elect to carry medical payments coverage. This is coverage available to you for medical expenses that exceed the PIP coverage or any other out-of-pocket medical expenses you may incur.

Bodily injury claims

In order to have a claim against the at-fault driver in the Commonwealth, the law requires that you incur in excess of $2,000 in reasonably related medical bills. It is important to seek proper medical attention for your injuries and to document the extent of your injuries.

Uninsured claims

This portion of your own automobile insurance provides benefits to you when the driver of the at-fault vehicle either does not carry their own insurance or when the at-fault party cannot be identified. An example of an uninsured claim is a hit-and-run accident. You can have a claim against your own policy if you are injured and entitled to recover from the at-fault, but unidentified party.

The minimum required coverage in the Commonwealth is $20,000 per person and $40,000 per accident. As with all coverage, you may elect to have higher limits.

Underinsured claims

This portion of insurance may apply when the coverage of the at-fault automobile is insufficient to compensate you for the injuries sustained.

As with uninsured motorist coverage, you may elect to have higher limits than the state mandatory coverage.

Work-related motor vehicle accidents

If you were involved in a motor vehicle accident and suffered injuries while in the course and scope of your employment, you may be entitled to workers? compensation benefits. You may also bring a claim against the at-fault driver.
