Bicycle Accidents

The number of bicyclists has risen dramatically across Massachusetts over the last decade. And with that increase has come a similar rise in the number of bicycle accidents. Just between 2010 and 2012, bicycle accidents in Massachusetts rose 12%, with about 70% of those accidents resulting in injuries. Unfortunately, many of those injuries are serious because bicyclists typically have very little protection from motor vehicles and other outside elements. Injuries from bicycle accidents often include minor scraps and cuts, broken bones, head injuries, and even death. In Boston alone, at least 13 people have been killed in bicycle accidents over the last 5 years, with victims ranging in age from 8 to 74. Given that cities and towns in Massachusetts are investing significant funding into expanding infrastructure for bicyclists, these numbers are expected to continue to rise.

Massachusetts Law Regarding Bicycle Accidents

Under Massachusetts law, if you are struck by a motor vehicle while riding a bicycle, you are entitled to up to $8,000 in personal injury protection (PIP) benefits to cover medical bills, lost wages, and replacement services. These benefits are available to bicyclists regardless of who caused the accident. If the driver of the motor vehicle was negligent, a bicyclist also has a right to pursue the bodily injury insurance coverage of the driver and/or owner of the vehicle. In many cases, given the severity of injuries that often result from bicycle accidents, there may not be enough bodily injury insurance available. In that case, bicyclists can look to their own motor vehicle insurance coverage to pursue underinsured motorist coverage.
