Under Massachusetts law, if you are struck by a motor vehicle while riding a bicycle, you are entitled to up to $8,000 in personal injury protection (PIP) benefits to cover medical bills, lost wages, and replacement services. These benefits are available to bicyclists regardless of who caused the accident. If the driver of the motor vehicle was negligent, a bicyclist also has a right to pursue the bodily injury insurance coverage of the driver and/or owner of the vehicle. In many cases, given the severity of injuries that often result from bicycle accidents, there may not be enough bodily injury insurance available. In that case, bicyclists can look to their own motor vehicle insurance coverage to pursue underinsured motorist coverage.
