A 55 year old women with cystic fibrosis and 25-year double-lung transplant survivor, was injured in a motor vehicle accident when her vehicle was struck while stopped at a rotary following a collision between two other vehicles. Liability was undisputed.
As a result of the crash, she sustained a lumbar compression fracture, a head injury with permanent scarring, and an aggravation of pre-existing back pain. These injuries significantly limited her ability to maintain the high level of physical activity necessary to preserve her lung function.
This limitation created a critical and complex medical risk: reduced activity could accelerate the need for a second lung transplant, while that same reduction in activity could simultaneously disqualify her as a transplant candidate.
