Seja para uma noite de encontros ou para uma fuga do tempo gelado, muitas pessoas acham o cinema um \u00f3timo lugar para ir ao cinema e fugir.<\/p>\n<p>Todos n\u00f3s entramos no cinema com nossa gigantesca banheira de pipoca, nachos, doces ou refrigerantes e nos sentamos para curtir o filme. Quantos de n\u00f3s, por\u00e9m, lembramos de jogar o lixo fora depois do filme? Quantas vezes voc\u00ea j\u00e1 se sentou para encontrar o lixo em seu assento ou quase trope\u00e7ou em um recipiente de pipoca vazio que foi deixado no corredor? \u00c9 prov\u00e1vel que isso tenha acontecido com cada um de n\u00f3s pelo menos uma vez.<\/p>\n<p>A nova jurisprud\u00eancia em Massachusetts sustentou recentemente que as salas de cinema est\u00e3o em uma situa\u00e7\u00e3o \u00fanica, onde o audit\u00f3rio escurecido aliado ao esperado descarte de recipientes usados para bebidas vendidos nas instala\u00e7\u00f5es cria um cuidado acrescido, exigindo maior aten\u00e7\u00e3o \u00e0 seguran\u00e7a por parte do propriet\u00e1rio do teatro.<\/p>\n<p>A teoria do 'modo de opera\u00e7\u00e3o' da responsabilidade [ver Sheehan v. Roche Brothers Supermarkets, Inc., 448 Mass. 780 (2007)] dita que os h\u00f3spedes ou clientes em instala\u00e7\u00f5es como supermercados, lojas, teatros ou hot\u00e9is t\u00eam o direito de esperar que os anfitri\u00f5es fa\u00e7am preparativos muito maiores para sua seguran\u00e7a do que at\u00e9 mesmo um propriet\u00e1rio de casa levaria para seus h\u00f3spedes. O Tribunal Superior de MA no mais recente caso Mills v. American Multi-Cinema, Inc., sustentou que um teatro \u00e9 um local \u00fanico. \u00c9 um espa\u00e7o pouco iluminado ou escuro quando a apresenta\u00e7\u00e3o est\u00e1 sendo mostrada e h\u00e1 alimentos e vendedores de concess\u00f5es oferecendo aos convidados a compra de alimentos e bebidas e levando-os para o audit\u00f3rio escuro. As pessoas que entram frequentemente n\u00e3o conseguem observar as condi\u00e7\u00f5es do piso, corredores e assentos que poderiam conter perigos para os clientes insuspeitos.<\/p>\n<p>Portanto, quando voc\u00ea for ao cinema neste fim de semana e entrar no teatro escuro, por favor, seja cauteloso onde estiver caminhando. Jogue fora seu lixo quando sair do teatro e, por favor, informe ao gerente do teatro se voc\u00ea notar uma situa\u00e7\u00e3o perigosa.
