{"id":2442,"date":"2012-11-19T00:00:00","date_gmt":"2012-11-19T00:00:00","guid":{"rendered":"http:\/\/kecheslaw.wpengine.com\/uncategorized\/supermarket-slip-and-fall-accidents\/"},"modified":"2020-06-29T18:35:39","modified_gmt":"2020-06-29T18:35:39","slug":"supermarket-slip-and-fall-accidents","status":"publish","type":"post","link":"https:\/\/kecheslaw.com\/pt\/noticias\/acidentes-com-supermercados\/","title":{"rendered":"Deslizamento de Supermercados e Acidentes de Queda"},"content":{"rendered":"<p>A semana de A\u00e7\u00e3o de Gra\u00e7as est\u00e1 chegando e com todos fazendo uma ou duas compras extras, ela traz \u00e0 mente a atualiza\u00e7\u00e3o relativamente recente da lei de Massachusetts no que diz respeito a <a href=\"https:\/\/kecheslaw.com\/pt\/areas-de-pratica\/danos-pessoais\/acidentes-com-deslizamento-de-terra\/\">acidentes com escorreg\u00f5es e quedas<\/a> em produtos e outras \u00e1reas de \"self-service\" da mercearia.<\/p>\n<p>Quase todas as mercearias t\u00eam \u00e1reas de auto-atendimento onde os clientes podem classificar e escolher seus pr\u00f3prios alimentos, sendo a se\u00e7\u00e3o de produtos o exemplo mais \u00f3bvio. Quando o produto cai no ch\u00e3o, ele cria uma condi\u00e7\u00e3o insegura e um risco de escorregamento. Ferimentos graves podem resultar de tal escorregamento e quedas. Antes de 2007, se um cliente da loja escorregasse e ca\u00edsse sobre um produto alimentar que tivesse ca\u00eddo no ch\u00e3o, esse cliente seria obrigado a provar que a mercearia ou fez com que o produto alimentar estivesse no ch\u00e3o ou que soubesse que o produto alimentar estava no ch\u00e3o ou que o produto alimentar estava no ch\u00e3o por tanto tempo que a mercearia deveria estar ciente da condi\u00e7\u00e3o insegura. Esta foi uma norma dif\u00edcil, mas n\u00e3o imposs\u00edvel, de ser cumprida pelos clientes feridos.<\/p>\n<p>Em 2007, a Suprema Corte Judicial de Massachusetts decidiu Sheehan v. Roche Brothers Supermarkets, Inc., 448 Mass. 780, 791 (2007). Esse caso envolveu um cavalheiro que foi escorregado e caiu sobre uma uva no departamento de produ\u00e7\u00e3o, sofrendo ferimentos graves. O tribunal inferior ficou do lado da mercearia, dizendo que o cliente n\u00e3o podia provar que a loja tinha conhecimento real ou construtivo da uva no ch\u00e3o. Sustentou que se uma condi\u00e7\u00e3o insegura fosse razoavelmente previs\u00edvel e resultante de um neg\u00f3cio de auto-servi\u00e7o ou modo de opera\u00e7\u00e3o do propriet\u00e1rio, e o cliente escorregasse como resultado da condi\u00e7\u00e3o insegura, o cliente arcaria com o \u00f4nus de provar o requisito de aviso descrito acima. Sheehan v. Roche Brothers Supermarkets, Inc., 448 Mass. 780, 791 (2007). Em outras palavras, se um item cair no ch\u00e3o em um departamento da mercearia, como o departamento de produ\u00e7\u00e3o, a mercearia j\u00e1 \u00e9 avisada de que os itens podem cair no ch\u00e3o, criando um risco de escorregamento inseguro. Se um cliente escorregar em tais itens ca\u00eddos, a mercearia \u00e9 agora respons\u00e1vel independentemente do tempo em que o item ca\u00eddo tenha ficado no ch\u00e3o.
