Como come\u00e7ou <\/strong><\/h2>\n\n\n\n

O cliente de Silva, um homem de 64 anos de Massachusetts que trabalhou como encanador por 40 anos, sofreu uma grave les\u00e3o no ombro enquanto fazia seu trabalho em dezembro de 2012. Ele estava apertando um parafuso velho e enferrujado quando ouviu um estalo no ombro, uma les\u00e3o que mudou tudo para ele. Ele tentou continuar trabalhando por v\u00e1rios anos ap\u00f3s a les\u00e3o, mas acabou tendo que parar completamente em 2020. <\/p>\n\n\n\n

De 2021 a 2023, o cliente de Silva conviveu com a realidade de que seus pagamentos por invalidez poderiam parar de chegar porque a seguradora achava que ele estava apto a voltar ao trabalho e deveria parar de receber seus pagamentos. <\/p>\n\n\n\n

Kelli Silva assumiu o caso em 2022. Ela juntou um pedido de benef\u00edcios por invalidez permanente e total \u00e0 solicita\u00e7\u00e3o de interrup\u00e7\u00e3o da seguradora, o que levou a uma audi\u00eancia em mar\u00e7o de 2023. Antes da audi\u00eancia, a seguradora rejeitou o argumento de invalidez permanente e total, avaliando o caso como apenas um pedido de invalidez parcial. A seguradora estava argumentando que o funcion\u00e1rio poderia trabalhar em alguma capacidade e, portanto, deveria se qualificar apenas para invalidez parcial.  <\/p>\n\n\n\n

No entanto, Silva argumentou que n\u00e3o s\u00f3 estava totalmente incapacitado, como tamb\u00e9m estava \"permanente e totalmente\" incapacitado porque, com base em sua idade, forma\u00e7\u00e3o, trabalho anterior e gravidade de sua condi\u00e7\u00e3o, ele nunca mais voltar\u00e1 ao mercado de trabalho. <\/p>\n\n\n\n

A distin\u00e7\u00e3o era importante. A invalidez permanente e total paga ao requerente 66,6% de seu sal\u00e1rio pelo resto de sua vida, enquanto a invalidez total cobre apenas 60% do sal\u00e1rio de algu\u00e9m por 3 anos. <\/p>\n\n\n\n

Quando a audi\u00eancia terminou, o juiz concedeu ao cliente de Silva pagamentos por invalidez permanente e total a partir de dezembro de 2021 a uma taxa de mais de $60.000 por ano. Al\u00e9m disso, o juiz determinou que a seguradora pagasse por todo o tratamento m\u00e9dico relacionado. <\/p>\n\n\n\n
