A 45-year-old woman suffered food poisoning from eating a salmon dinner at a restaurant. She was hospitalized and discovered to have an E. coli O157:H7 infection. She subsequently developed Hemolytic Uremic Syndrome, requiring plasmapheresis, and suffered renal failure due to fluid overload, which required hemodialysis treatment.
The plaintiff was discharged after 20 days and returned to work full-time shortly after that; however, she continued to suffer gastrointestinal problems.
The plaintiff’s expert nephrologist concluded that she is at greater risk of renal failure as she ages. An expert epidemiologist opined that the plaintiff contracted E. coli poisoning from the salmon dinner.
The plaintiff’s claims against the restaurant were settled at pre-suit mediation for $1 million.
